GOP Ohio voter bid rejected

WASHINGTON -- The Supreme Court sided Friday with Ohio's top elections official in a dispute with the state Republican Party over voter registrations.

The justices overruled a federal appeals court that had ordered Ohio's top elections official to do more to help counties verify voter eligibility.

Secretary of State Jennifer Brunner, a Democrat, faced a deadline of Friday to set up a system to provide local officials with names of newly registered voters whose driver's license numbers or Social Security numbers on voter registration forms don't match records in other government databases.

Ohio Republicans contended the information for counties would help prevent fraud. Brunner said the GOP is trying to disenfranchise voters.

In a brief unsigned opinion, the justices said they were not commenting on whether Ohio is complying with a provision of the Help America Vote Act of 2002 that lays out requirements for verifying voter eligibility.

Instead, they said they were granting Brunner's request because it appears the law does not allow private entities, like the Ohio GOP, to file suit to enforce the the law at issue.

"They didn't deal with the merits of the case," said Ohio GOP Chairman Bob Bennett. "What they dealt with was a technicality on whether we had standing or not to bring the action."

About 200,000 of 666,000 voters registered in Ohio since Jan. 1 have records that don't match. Brunner has said the discrepancies likely stem from innocent clerical errors rather than fraud but has set up a verification plan. Bennett said Brunner could have set up a system months ago to check the discrepancies and that her actions have left the potential for voter fraud. "If we have a close election in Ohio and there's any doubts, the failures will be laid right at her doorstep," Bennett said.

Voter files legal challenge in Ohio voting dispute

An Ohio voter filed a legal challenge Friday in a dispute over verifying new voter registrations just hours after the U.S. Supreme Court rejected a similar challenge made by the Republican party.

David Myhal, a registered Republican in the Columbus suburb of New Albany, asked the Ohio Supreme Court to order Secretary of State Jennifer Brunner, a Democrat, to help counties verify voter eligibility.

A federal appeals court had given Brunner a deadline of Friday to set up a system to provide local officials with names of newly registered voters whose driver's license numbers or Social Security numbers on voter registration forms don't match records in other government databases.

Brunner appealed, and the U.S. Supreme Court said it was granting Brunner's request because it appears that the law does not allow private entities, like the Ohio GOP, to file suit to enforce the provision of the law at issue.

The justices, in a brief unsigned opinion, did not comment on whether Ohio is complying with a relevant provision of the Help America Vote Act of 2002 that lays out requirements for verifying voter eligibility.

Ohio GOP Chairman Bob Bennett said the high court didn't deal with the merits of the case.

"What they dealt with was a technicality on whether we had standing or not to bring the action," he said.

Myhal's lawsuit, which misspells his last name as "Mahal" in the case name, states that the U.S. Supreme Court's ruling forced him to ask the Ohio Supreme Court to intervene.

Phone messages left for Myhal and his attorneys were not immediately returned.

Brunner's spokesman Jeff Ortega said of Myhal's challenge: "It's time for the Ohio Republican Party to stop injecting chaos and confusion into our excellent bipartisan election system."

The Ohio Democratic Party accused the state GOP of desperation and partisanship.

"It took the Ohio Republican Party less than six hours to shrug off a unanimous ruling from the United States Supreme Court and renew their desperate, hyper-partisan campaign to disenfranchise Ohio voters who have done absolutely nothing wrong," party spokesman Alex Goepfert said in a statement.

About 200,000 of 666,000 voters who have registered in Ohio since Jan. 1 have records that don't match. Brunner has said the discrepancies most likely stem from innocent clerical errors rather than fraud, but she has set up a verification plan.

Ohio Republicans said the U.S. Supreme Court ruling failed to address what they called Brunner's partisan interpretation of voting laws and will increase the potential for fraud on Nov. 4.

"If we have a close election in Ohio and there's any doubts, the failures will be laid right at her doorstep," Bennett said.

Bennett said Brunner could have set up a system months ago to check the discrepancies and that her actions have left the potential for voter fraud.

Brunner said the court's decision would help ease confusion in the run-up to Election Day.

She said Help America Vote Act was clear that the mismatch lists were to be used to maintain the voter database, not to determine voter eligibility.

"We are very pleased that the court recognized that this was an illegal challenge on the part of the Republicans," she said.

She said the office would have found a way to comply, but there were risks that qualified voters would have been disqualified.

"I think it's an unfair tactic to subject voters to this kind of uncertainty and anxiety this close to such an important election," she said.

In court filings, the GOP has not produced any specific evidence of voting fraud, only unsubstantiated reports that voters from other states had cast fraudulent ballots during the early voting period.

McCain campaign manager Rick Davis said lower court rulings have clearly said the HAVA regulations require the secretary of state to match against the list, find where there's been fraud and inconsistencies and report them to counties.

"Why in the world would that not happen? We have the technology, the budget, the means and the manpower to make that happen. Do we really want to have to find out after the fact that we had counties that would have been decided one way or another because the secretary of state didn't bother doing the job the HAVA required?" Davis told reporters on a conference call. "I think the secretary of state ought to do her job," he added.

The United States aided Iraq in the Early 1980s during the Iraq-Iran War.

Keep in mind this was during the cold war;

Balance of Power was the issue in the region.


Not saying Bush has not made mistakes in the war on terror


But negiotating with terror is not the answer

Not only will the USA be filled with welfare cases but deformed inbred people as well. Hypothetically of course, since people are so fond of the what could happen point of view.

If the supreme court is filled with pro-life judges it's a real possibility. I doubt the supreme court will ever be filled with pro-life judges though. The idea that it could be overturned is as likely as the idea of America becoming an Islamic republic or being handed over to terrorists. That was my point. Even if by some rare chance that that is what Obama's secret plan is the American people and military would never let it happen. the Democrats and Liberals in congress wouldn't let that happen either. Just because there are a few bad apples doesn't mean they all are.

I bet McCain and Palin's view on abortion would change if someone raped one of their family members; causing a pregnancy

I am against abortion in most cases

But If a woman is raped or a victim of incest; They should be allowed to end their pregnancy

Obama's lead slips to 3 points

WASHINGTON (Reuters) - Democrat Barack Obama's lead over Republican John McCain in the presidential race has dropped to 3 points, according to a Reuters/C-SPAN/Zogby poll released on Sunday.

Obama leads McCain by 48 to 45 percent among likely U.S. voters, down 1 percentage point from Saturday. The four-day tracking poll, which has a margin of error of 2.9 points.

Pollster John Zogby said the numbers were good news for McCain, and probably reflected a bump following his appearance in the third and final presidential debate on Wednesday.

"For the first time in the polling McCain is up above 45 percent. There is no question something has happened," Zogby said.

He said the Arizona senator appeared to have solidified his support with the Republican base -- where 9 out of 10 voters now back him -- and was also gaining ground among the independents who may play a decisive role in the November 4 election.

Obama's lead among independent voters dropped to 8 points on Sunday from 16 points a day earlier.

'RED FLAGS'

"If that trend continues, it is something that has got to raise red flags for Obama," Zogby said. "It suggests to me that his outward look of confidence may be as much strategy as it is real."

Other national polls have given Obama a double-digit overall lead, fueled by perceptions he would do a better job managing the faltering economy and unhappiness with McCain's attacks on him over the past week.

But he has cautioned his supporters against overconfidence and most polls now put his lead in single digits.

Obama, 47, who would be the first black president, enjoys strong support among black, Hispanic, Catholic and Jewish voters while the 72-year-old McCain holds a narrower lead among male and white voters.

Women, who are expected to be an important factor in the election, still favor Obama by a 6-point margin, although this has been declining in recent days.

Independent Ralph Nader drew 2 percent support in the poll, conducted Saturday through Tuesday, while Libertarian Bob Barr registered 1 percent, both little changed.

The rolling tracking poll surveyed 1,210 likely voters in the presidential election. In a tracking poll, the most recent day's results are added while the oldest day's results are dropped in an effort to track changing momentum.

The U.S. president is determined not by the most votes nationally but by a majority of the Electoral College, which has 538 members allotted to all 50 states and the District of Columbia in proportion to their representation in Congress.

PALIN PROVES SHE'S E-QUIPPED FOR 'SNL'

Was she funny? You betcha!

Sarah Palin raised the roof last night on her "Saturday Night Live" debut, yukking it up with Alec Baldwin and executive producer Lorne Michaels as she watched dead-ringer Tina Fey lampoon her at a fake news conference.

Fey, the show's former head writer, who donned a red blazer and Palin's up-swept do and glasses, took a poke at the Alaska governor's press-shyness.

The screen then cuts to "SNL" show creator Michaels and the real Palin watching the show backstage.



"I just didn't think it was a realistic depiction of what my press conferences are like," the Republican veep hopeful said to Michaels.

All of a sudden, Baldwin strolled up and mistakes the Alaskan governor for his "30 Rock" castmate, Fey, pleading with Michaels not to let "Tina" do the show with Palin, whom he calls "Caribou Barbie."

"You can't let Tina go out there with that woman. She goes against everything we stand for," the notoriously liberal actor said. "This is the most important election of our lifetime."

After Michaels points out that he's speaking to the real Gov. Palin, a red-faced Baldwin backtracks and said, "Forgive me, but I feel I must say this, you're way hotter in person."

"I can't believe they let her [Fey], you know, play you," Baldwin said.

Palin shot back, "You know, your brother, Stephen, [a conservative] is my favorite Baldwin."

After the pair strode off to the set arm in arm, Baldwin walked up to Fey, who is still in character, and whispered in her ear. Fey then exclaimed, "The real one?" and walked away from the podium, crossing Palin on stage.

The country's most famous hockey mom then deadpaned: "I'm not going to take any of your questions, but I do want to take this opportunity to say, live, from New York, it's Saturday Night."

Palin returned to the stage for the Weekend Update segment, bopping to a rap by Amy Poehler while Eskimos, a moose, and a snowsuit-clad man danced in the background.



"All the mavericks in the house, put your hands in air!" Poehler yelled as Palin pumped her hands in the air.

The show, hosted by Josh Brolin, who plays President Bush in the biopic "W." joked in the opening monologue that he was in a recent political movie, "No Country For Old Men."

"It was about John McCain," he quipped.
