DETROIT -- Wayne County Prosecutor Kym Worthy received a rousing round of applause Tuesday before the City Council, but remained mum afterward about her ongoing prosecution of Mayor Kwame Kilpatrick.
Worthy, Sheriff Warren Evans and other law enforcement officials attended the hearing to receive recognition from the council for the Fugitive Safe Surrender program
"We were happy to be a part of it," Worthy said. "The key word is cooperation."
The City Council chambers were abuzz before the meeting as the audience and council staff theorized why Worthy and Evans were in attendance. Evans left the meeting before actually accepting the award.
The program was held in June by several law enforcement agencies in order to give fugitives a chance to surrender in a non-threatening atmosphere. The event broke records with nearly 7,000 people, mostly with warrants for low-level offenses, turning themselves in during the four-day program at the Second Ebenezer Church with the hope of more lenient treatment by the courts.
Speaking with reporters afterward, Worthy declined comments about her investigation into Kilpatrick.
Asked if she noticed that she received the most cheers among law enforcement officials at the meeting, she said, "yes."
But she quickly added, "I have no idea" why.
Worthy is prosecuting Kilpatrick on several felony charges related to allegations he perjured himself during a civil police whistle-blower trial last year and authored a $8.4 million settlement to cover up the perjury. | |

Gov. Jennifer Granholm has denied a request from lawyers for Detroit Mayor Kwame Kilpatrick for a two-month delay of hearings for Granholm to decide whether to remove Kilpatrick from office.
While granting the mayor’s lawyers up to five extra days to file legal briefs in the matter, Granholm said today she is sticking with Sept. 3 as the date for the mayor’s removal hearings to begin.
Granholm personally responded to the mayor’s general counsel, Sharon McPhail, in a curtly worded letter that said McPhail had “failed to establish good cause” for the extension.
McPhail had said the mayor would need an additional 60 days because a fire at city hall had kept the mayor’s legal team from gaining access to records.
“Given the extraordinary circumstances, it is my hope that you will allow us some additional time to prepare the necessary pleadings,” McPhail wrote. “I think it is important for all of us to submit cogent, yet brief, pleadings that will not require an inordinate amount of the time of your office to review.”
McPhail also wrote Granholm that she and Kilpatrick’s other attorney, Jim Thomas, have been swamped with the workload of Kilatprick’s defense against perjury charges by Wayne County Prosecutor Kym Worthy, and McPhail’s other duties as city legal counsel.
Granholm, in her response, noted that city hall had only been closed for less than two weeks.
Granholm also noted that McPhail is one of at least four attorneys representing Kilpatrick in legal proceedings, and thus cannot justify an extension.
Instead, Granholm added five days to the deadline for attorneys for Kilpatrick and the City Council to file briefs and motions to her, and five extra days for responses to one another.

Prosecutors may ask for even tighter bond restrictions on Detroit Mayor Kwame Kilpatrick after a judge said he took a trip to Windsor last week without court authorization.
Maria Miller, spokeswoman for Wayne County Prosecutor Kym Worthy, said prosecutors will raise the issue at a previously scheduled hearing next Thursday before 36th District Judge Ronald Giles concerning the admissibility of text messages in Kilpatrick's criminal case.
Kilpatrick crossed the border July 23 to meet with Windsor Mayor Eddie Francis on a plan to sell Detroit's half of the Detroit-Windsor Tunnel for $75 million.
Chief Judge Marylin Atkins of Detroit's 36th District Court said Wednesday that Kilpatrick is required to give court officials written notice of travel, but he didn't before going to Windsor.
She also said there's no indication the meeting was an emergency. "This stuff is all planned out," she said. "Anyway, there wasn't even a phone call."
Giles revoked Kilpatrick's $75,000 personal bond Friday amid allegations he shoved a sheriff's detective trying to serve a warrant. He remains free after posting 10% of the bond, or $7,500.
Last week, mayoral spokesman James Canning told the Free Press the mayor complied with court-ordered travel requirements.
Marcus Reese, spokesman for the mayor's legal team, said Wednesday the mayor's trip to Windsor "was critically important." He declined to say whether the mayor made any effort to tell court officials about the trip.

Roger Penske, one of Detroit’s top business leaders, said today the city’s business community should not be involved in determining the future of embattled Detroit Mayor Kwame Kilpatrick.
“This is not a business community issue,” he told the Free Press shortly after Gov. Jennifer Granholm announced a new investment initiative for the state this morning. “There’s a legal issue taking place.”
The chairman and chief executive of the Penske Corp., who has played a major role in efforts to spur investment in Detroit, said the business community has to focus on the outcome of the mayor’s situation and try to “regain the momentum the city had prior to the issue.”
“I’m disappointed we’re in this situation,” Penske said. “I hope that the process will be speedy and we’ll get a resolution quickly.
“Obviously this has some impact on the city,” he added, noting that Kilpatrick’s legal woes “takes our eyes off the ball.”
Penske’s comments come amid mounting worries about Detroit’s future as the mayoral scandal intensifies. The city’s business leaders have largely stayed on the sidelines as the controversy has unfolded.
Penske is one of the region’s few business leaders willing to speak publicly about the mayor’s problems.
Dave Bing, head of the Bing Group and a former NBA star, has spoken out against Kilpatrick’s efforts to remain in office after being charged with eight felony counts in March. But Peter Karmanos, chairman and chief executive of Compuware Corp., said earlier this year that the mayor should not resign because he’s “the best we’ve got.”
Like Penske, Granholm today also emphasized the importance of the legal system in determining a resolution to the mayor’s situation.
Under state law, she told reporters that the governor cannot just go in and remove Detroit’s mayor.
“Clearly it is in the public’s interest to have a resolution,” she said. “But the process must be honored.”
Holding a hearing is a key first step in the process to consider Kilpatrick’s removal from office. The Gov. recently moved up the date of the hearing to Sept. 3rd.
When asked whether she is concerned about Kilpatrick allegedly assaulting a sheriff’s deputy last week, the Gov. said, “I’m concerned about anything that makes Michigan look even more challenged.”

A lawyer for Detroit Mayor Kwame Kilpatrick said Monday that the mayor has declined to talk directly to Michigan State Police, who are investigating his alleged shove of a sheriff's detective last month.
Defense attorney James Thomas said Monday the mayor is willing to cooperate as much as he can with the investigation, short of talking with State Police.
"The mayor is not going to be making any statement," Thomas said.
It is not unusual for police to make such a request of a suspect in a criminal investigation, sometimes more than once. It's also not unusual for a potential defendant -- in this case, through his lawyer -- to decline the request.
State Police did not return a call seeking comment Monday.
The agency is expected to wrap up its investigation of Kilpatrick soon and turn over its findings to Michigan Attorney General Mike Cox, who will decide whether to prosecute Kilpatrick. Assaulting a law-enforcement officer could result in a felony charge.
Kilpatrick is accused of berating and then shoving a sheriff's detective into an investigator when the detective attempted to serve a subpoena on the mayor's friend. Kilpatrick, through his lawyer, has said he merely "gently" escorted the detective from the home. | |

DETROIT -- A judge on Thursday ordered Mayor Kwame Kilpatrick to jail, shocking the city and plunging the leadership of the nation's 11th-largest city into uncertainty.
Despite a plea from Kilpatrick that invoked his sons, his respect for the judicial process and his love of the city, 36th District Judge Ronald Giles was unmoved. He revoked Kilpatrick's bond, ordering him to jail on a bond violation for a July 23 trip to Windsor.
As Kilpatrick's lips quivered, Giles ended a short speech by concluding: "If it was not Kwame Kilpatrick sitting in that seat, if it was John Six-Pack sitting in the seat, what would I do? That answers something. So I go back to my original, 'Keep it simple.'
"That's what I have to do ... the court is revoking your bond, that all travel be suspended, and two, that you to be remanded to Wayne County Jail."
Wayne County sheriff's deputies were expected to pick up Kilpatrick from 36th District Court at noon and transport him to the main jail on St. Antoine, said John Roach, a spokesman for Sheriff Warren Evans. At 11:30 a.m., he said deputies were still working out lodging arrangements, such as whether Kilpatrick will be in solitary confinement.
Kilpatrick will spend the night in jail. His attorneys immediately appealed to Wayne Circuit Judge Thomas E. Jackson, who said he will hear the appeal at 9 a.m. Friday. Conceivably, Kilpatrick could be released if he posts his entire $75,000 bond.
The order from Giles came after Kilpatrick threw himself at the court's mercy, acknowledging he violated the terms of his bond with the trip.
He said he instructed his sons to watch the proceedings because he respects the process so much. Appearing contrite, he said he is under "tremendous strain and scrutiny" but traveled to Windsor to revive a sagging deal to sell the city's share of the Detroit-Windsor Tunnel and avert 2,000 layoffs looming in September without the $65 million deal.
"I respect this process more than I've respected any process in my life and I'm sorry," said Kilpatrick, who wore a gray suit.
"I did violate the conditions of this bond."
A lawyer, Kilpatrick said his life has been "revolutionarily transformed" by the criminal case and "transformed by a media that doesn't know me at all. I ask for your forgiveness. It will never happen again."
Giles wasn't convinced. Earlier in the proceeding, he asked Kilpatrick's attorney, James C. Thomas, why he had to learn about the case from the media.
"Who was dying? Who was sick?" Giles asked.
"The city of Detroit," Thomas said.
In sending Kilpatrick to jail, Giles said:
"I don't in any way claim to have a good understanding of what your responsibilities are and what you do," he said. "I do understand you have to be under a tremendous amount of pressure and how that can affect you. But I have to look at how the system is run and is perceived by the public.
"I don't care what the media says about me. I really don't. I never have. I try to do what I think is right and fair...
"In this case, in the beginning, you were given every privilege that could be given to you in regards to travel, totally unrestricted initially. (Later) I felt you were abusing the privilege, and I modified the bond."
The mayor's bottom lip stuck out, and he had his fingers to his mouth as Giles spoke.
It's unclear who is running Detroit.
Councilwoman Sheila Cockrel said she has formally requested an answer from the mayor's office who is acting as mayor. Kilpatrick's No. 2, Anthony Adams, has left for another post.
"It's a tragedy," Cockrel said. "It's a tragedy for the mayor's family and the city. The mayor needs to resign and end this for all of us in this city and region."
Council President Kenneth V. Cockrel Jr. said the latest development should increase pressure on Kilpatrick to step down. Kilpatrick has resisted those calls since he was charged in March.
"It's just another unfortunate chapter," he said. "This is another set of world wide headlines that make us an international punch-line.
"Behind the scenes, momentum for him to go is building," Cockrel said.
But he's not convinced that it will change Kilpatrick's grip on his job.
"I'm not in his head," Cockrel said. "I don't see how the city's best interests are served by prolonging the agony with this.
"It's not good for the region and not good for the state."
Cockrel said he has a 100-day plan if he has to take over as mayor, but declined to get into specifics.
"Should it become necessary, I am prepared to step up and do what I need to do," Cockrel said. "It started thinking about it a couple months ago."
Assistant Wayne County Prosecutor Robert Moran had asked the judge to revoke the bail -- and at the very least restrict his travel -- because Kilpatrick "isn't taking responsibility" for violating his bond with the 45-minute trip to Windsor.
"He didn't notify anyone ... he left country, he left the state ...but we found out about it from the media," Moran said. "That is a flagrant violation of bond."
"This is just not serious to him," Moran said. "We want the travel cut off ... this court should be outraged."
An attorney for Kilpatrick, James Parkman, said Giles' order did not come as a surprise.
"There are some options that are less extreme," Parkman said, referring to tethering and restricted travel
The jailing came after Kilpatrick and his former chief of staff, Christine Beatty, waived their right to a preliminary hearing in multiple felonies and agreed to proceed directly to trial. The July 23 trip also happened the day before Kilpatrick allegedly had a physical confrontation with a Wayne County sheriff's detective that resulted in Giles increasing the mayor's personal recognizance bond to 10 percent of $75,000, tightening his travel restrictions and ordering random drug tests.
One of Kilpatrick's lawyers said Wednesday that he also expects the mayor will be charged soon by state Attorney General Mike Cox in connection with the July 24 incident in which Kilpatrick is alleged to have shoved Wayne County Detective Brian White, the chief criminal investigator on the case, on the front porch of the home of the mayor's sister, Ayanna.
White and prosecutor's investigator JoAnn Kinney testified at a bond hearing before Giles on July 25 that they were attempting to serve a subpoena on Bobby Ferguson, a city contractor and friend of Kilpatrick's who was expected to testify at the preliminary examination.
Also, Kilpatrick and Beatty are accused of lying under oath to cover an affair and the firing of a deputy police chief; and misleading the City Council into an $8.4 million settlement with a secret side agreement to keep secret hide text messages that allegedly reveal the lies.
Both were charged March 24 with multiple crimes that carry a maximum of up to 15 years in prison. Although a preliminary examination where a judge decides if there is enough evidence to bind defendants over for trial in Wayne County Circuit Court usually happens within 14 days, battles over evidence in this case caused Giles to delay the probable cause hearing until Sept. 22.
The Rev. Horace Sheffield, a leader on a fund to raise money for the mayor, said he hopes the mayor will offer up some sort of deal to put an end to the situation.
"I love the mayor like my own son," Sheffield said. "But even my son at some point would have to learn to abide by the restraints he placed upon himself."
"While the mayor should be working himself out of this, he's giving others further reasons to bury him," Sheffield said. "My prayers are with him. I would hope that at some point that he would recognize how serious this is."
Political consultant Sam Riddle, a onetime adviser to Councilwoman Monica Conyers, said Kilpatrick will go to jail "because of his own arrogance."
"It's a good lesson for him. No one is above the law. He's always behaved as if he was above the law," Riddle said.
"If he really loved the city like he says he does, he would step down now. But he won't do that because he's selfish and self-serving."

Detroit Mayor Kwame Kilpatrick was ordered to jail this morning for violating his bond by traveling to Windsor. But really, this was 36th District Judge Ronald Giles also reacting to a whole string of Kilpatrick activities that would simply not be tolerated for anyone else awaiting trial on eight felony charges.
At last, Kilpatrick has to come to grips with what he is: a criminal defendant. It’s an extraordinarily humiliating day for the mayor but, as has been true from the start of this mess, he brought it on himself. And it’s an extraordinarily embarrassing day for the City of Detroit and the State of Michigan, which will once again be on the receiving end of the wrong kind of attention.
Since we now have a judge making a finding that Kilpatrick is a scofflaw, since we now have a mayor who cannot run the city -- day-to-day operations are in the hands of his unelected deputy -- this should make it a lot easier for Gov. Jennifer Granholm to do what she needs to do -- remove him from office.
Unless the mayor is now jolted to his senses and does what he should have done a long time ago, quits. | |

DETROIT -- Wayne County Sheriff Warren Evans said Thursday that Mayor Kwame Kilpatrick is being booked as a prisoner and treated just like any other inmate in his jail.
"He is going to be treated as any other prisoner in the county jail. No better. No worse," Evans said during a news conference shortly after 1:30 p.m. outside the Wayne County Jail across the street from the Detroit Police Headquarters and a short distance from Kilpatrick's office at the Coleman A. Young Municipal Center.
Evans said the mayor will not have a special phone, although he will have access to a jail phone. The system only allows prisoners to make collect calls.
"Once we get the numbers he wants to call, we'll have them programmed into the system and he can make calls that are approved collect calls," Evans said.
The mayor will be allowed visitors but they will be restricted to family members and his attorneys. Evans said the mayor will be put in a restricted area for high-profile inmates. Evans said Kilpatrick's cell is separated from the jail's general population.
"It's a witness protection area," he said.
The mayor will have to undergo a full body search, Evans added.
"He will be searched for contraband," Evans said. "He'll be searched like prisoners are searched. We have to do what we have to do."
Evans, also a lawyer, said he will follow the letter of the law. "I'm a custodial officer who has a responsibility to the court." | |

| Thursday, August 7, 2008 Deputy Mayor Kandia Milton: 'The city will continue to run at optimal level' David Josar / The Detroit News
DETROIT -- Deputy Mayor Kandia Milton, who is running the city as Mayor Kwame Kilpatrick remains in jail, said "the city will continue to run at an optimal level" until Kilpatrick returns.
Milton, a childhood friend of Kilpatrick's, said he had spoke with the mayor earlier Thursday. "His spirits were high." Milton said at the press conference.
He took two questions.
Milton also said there is a "mechanism" in place that will allow him to communicate with the mayor.
He repeated several times that the city's grass would continue to be cut and that the police would still "protect and serve."
"I'm here to assure the citizens that the government will continue to run," said Milton, standing in the mayor's conference room and surrounded by about 15 city directors and deputy directors.
The city has been hit by a rash of resignations the past several weeks.
The former deputy mayor, Anthony Adams, is now running the water department; the deputy chief operating officer, Al Fields, has taken a job with DTE; and Roger Short, the former chief financial officer, has formally retired.
Milton's brother, DeDan Milton, also works for the mayor as an assistant.
Milton was flanked at the press conference by about 30 Kilpatrick appointees, including Adams, Police Chief Ella-Bully Cummings and Treasurer Jeff Beasley.

| Thursday, August 7, 2008 EDITORIAL UPDATE: Kilpatrick jailing sends needed message Judge reminds mayor that he's not above law
If Detroit Mayor Kwame Kilpatrick didn't know before that being free on bond as a criminal defendant is a privilege rather than a right, he certainly does now.
Judge Ronald Giles of the 36th District Court ordered the mayor to jail this morning for violating his bond by making a business trip to Canada without informing the court.
As a condition of Kilpatrick's bond, he is not allowed to travel outside the state without the judge's permission. And while traveling to Windsor for a few hours to discuss city business may seem like a trivial violation, Giles is rightly frustrated with Kilpatrick's cavalier treatment of his bond conditions.
The mayor previously ignored the bond restrictions by traveling to Texas without informing the court and, most recently, was involved in a scuffle with a sheriff's detective trying to serve a warrant on Kilpatrick's friend, Bobby Ferguson.
Giles said he treated the mayor as he would any other criminal defendant. That's as it should be.
Kilpatrick's belief that the law doesn't apply to him is what got him in trouble in the first place.
While we are anguished by the renewed negative attention his jailing will bring Detroit, Kilpatrick needed to be reminded that in the eyes of the law, he's no better or worse than anyone else. Mayor or not, he's still a criminal defendant, and that designation carries very specific restrictions.
Perhaps some time behind bars will drive that fact home. | |
