DETROIT -- Wayne County Sheriff Warren Evans said he is certain Detroit Mayor Kwame Kilpatrick assaulted one of his officers during an alleged altercation Thursday.
"After looking at the reports and hearing the testimony, there is no question in my mind that an assault took place," he said. "The prosecution and defense can argue back and forth about the level of the assault, but I don't think anyone has a plausible argument that there wasn't an assault."
A team of up to six state police investigators is probing the allegations that Kilpatrick shoved or threw Detective Brian White, who was trying to serve a subpoena at the home of the mayor's sister, Ayanna.
Attorney General Mike Cox, not the Wayne County prosecutor, will determine whether to charge Kilpatrick because White works for Kym Worthy, the prosecutor.
"It wouldn't be appropriate for our office to handle the case," said Worthy spokeswoman Maria Miller.
White said the assault happened while he was attempting to serve a subpoena to Bobby Ferguson, a city contractor and close friend of the mayor. The subpoena would have forced Ferguson to appear at a Sept. 22 preliminary examination in the mayor's perjury and conspiracy case.
State Police Capt. Harold Love said his department has already contacted the Detroit Police and the Wayne County Sheriff's Office to talk with necessary people.
Evans said he was pleased White did not let the situation escalate.
"If he's being assaulted, he certainly has the legal authority to make an arrest," Evans said. "But that's not something that would make sense, given the situation. Thank goodness (White) didn't go tit for tat and try to retaliate."
The mayor's attorney James C. Thomas denied the allegations. Thomas told reporters Thursday that Kilpatrick merely escorted White away from the door. But even that went too far, Evans said.
"I'm also seriously concerned about the vulgarity; that whole name-calling that was testified to," Evans said. He was referring to a hearing in 36th District Court regarding Kilpatrick's bond. Afterward, Judge Ronald Giles ordered the mayor's bond set at $75,000; he posted the necessary 10 percent.

SOUTHFIELD -- Bobby Ferguson, a Detroit contractor and friend to Mayor Kwame Kilpatrick, still has not been served with a subpoena reportedly related to Kilpatrick's text message scandal, according to Wayne County investigators.
Ferguson dodged the subpoena Friday for the second time in as many days, ducking out of a Southfield courthouse minutes before process servers arrived from the Wayne County Prosecutor's Office.
Ferguson, 39, was in Southfield District Court for a pretrial hearing on a drunken driving charge. Ferguson's attorney, Brian Stacey, refused to accept service.
On Thursday, a deputy's attempt to serve the subpoena for Ferguson at the home of Kilpatrick's sister prompted an alleged pushing incident between the police and Kilpatrick, who may face assault charges. | |

DETROIT -- Mayor Kwame Kilpatrick's alleged assault and racially tinged tirade directed at a Wayne County Sheriff's detective will not force supporters to flee but could make it harder for him to raise money for his legal defense, community leaders and a pundit said Friday.
The accusations against Kilpatrick, disclosed Friday during a hearing in which his personal bond was revoked, will likely reinforce beliefs already held by supporters and opponents but may dampen chances business leaders, who have already largely closed their wallets, will contribute, said Eric Foster, a consultant with Detroit's Urban Consulting.
One supporter said Kilpatrick is under enormous pressure from prosecutors, City Council members, the media and others.
"I'm not giving the mayor a free pass ... but how many people can keep their cool when they've got 20 guns pointed at their head?" said the Rev. Horace Sheffield III, pastor of the New Galilee Missionary Baptist Church.
Business leaders were largely silent Friday. Executives Dan Gilbert, Mike Ilitch and others declined comment, could not be reached or did not return calls.
The incident with a Wayne County detective and his partner on Thursday illustrates a giant crack in Kilpatrick's demeanor, Foster said.
"It shows that all of this has definitely taken a very damaging toll on him personally to lose his professional cool like that," he said.
Some Detroiters said they were relieved to see the mayor reprimanded.
"I think he should pay like anybody else -- black or white," said Roger Lane, 40, who has served time in prison for assault. "When I assaulted somebody, I got seven to 15 (years)."The incident did draw responses from some public officials.
"Kwame ... is making it increasingly difficult not to condemn his bizarre behavior," Oakland County Executive L. Brooks Patterson said. "It's unfortunate. He's talented but day-by-day he is systematically screwing up what could have been a brilliant career."
Wayne County Executive Robert Ficano, meanwhile, said the mayor's behavior casts Detroit in an "unfavorable light."
"Police officers should always be able to do their jobs and be treated with respect," Ficano said through a spokeswoman.
The mayor's racial comments, as reported in court Friday, are "irrelevant," said the Rev. Malik Shabazz, a Detroit civic activist and outspoken Kilpatrick supporter.
"How do we know the deputies didn't see an opportunity to stick it to the mayor, harass the mayor further and to get a lawsuit down the line? That's the end thing. Sue Kwame?"
The mayor's behavior could hurt his ability to raise money. His defense fund raised $185,000 since April 4.
All but $20,000 has been spent and many business leaders have not contributed. Last month, the fund raised just $800.
Mike Sleimen, 34, was at Campus Martius Friday when he said he now feels less for Kilpatrick.
"You're a leader -- you should lead by example," said Sleiman, a Dearborn resident who owns Motown Kabob in Detroit. | |

Enough, already. The escalating disaster that is the Kwame Kilpatrick administration must end now. One more day is one too many.
The Detroit mayor placed what should be the final stamp on his ruinous tenure when he got himself involved in a physical dust-up with a Wayne County Sheriff's detective trying to serve paper on Kilpatrick's favorite city contractor, Bobby Ferguson.
It doesn't matter whether the mayor's belly bumping rises to criminal assault. He had no business interfering with an officer of the law, and his city-paid bodyguards certainly had no justification for screening a county process server.
Kilpatrick acts like a thug, hangs out with convicted thugs like Ferguson and has projected an image of thuggery on the city of Detroit.
His street scrapping follows his pronouncement earlier in the week that Prosecutor Kym Worthy is trying to use what Kilpatrick called the racism of the region to poison the jury pool that will ultimately be called on to decide his felony perjury and corruption charges.
The mayor is setting back regional race relations 20 years with bluster like that and a racially offensive remark aimed at the detective.
Kilpatrick has made Detroit a national joke. It will take years of excruciating work for the next mayor to restore Detroit's reputation and credibility.
He has to go. But he clings to his office entirely for personal gain, caring nothing for the damage his continued presence is doing. He stays so he can leverage his job to mitigate the consequences of a criminal conviction and to shake down city vendors for donations to his defense fund.
Until now, I've thought it would be a horrible move for Gov. Jennifer Granholm to use her authority to remove the mayor. My fear has been, and still is, that an outsider taking down a black Detroit mayor would spark a racial firestorm.
But Detroit is under mob rule; something has to be done and soon. The governor might be encouraged to act if the people of Detroit made it clear that they are ready for Kilpatrick to go.
A fledgling recall effort is ongoing, but it is way under-staffed and under-funded. It needs 58,000 valid signatures by the end of August.
But it also needs a lot more volunteers and a lot more vocal support from the so-called leaders of this community. And it needs money.
The business community has had little recourse during this scandal but to watch from the sidelines as their investment in Detroit dissolves. They've got something they can do now. They and others can write checks to give this recall movement the money it needs to succeed.
The recallers are so short of cash that they don't have phone lines. But they've got a Web site -- www.recallkilpatrick.com . Go there, and turn a struggling effort into a groundswell for tossing out this embarrassment.
Even if they get enough signatures, the earliest the recall can go to voters is early February.
By the time he cleans out his office, there may not be anything left of Detroit to save.

Yep. I mean I can't stand Kwame, but that site is a mess. It also speaks very poorly of Bush. As perhaps the most liberal person on this board I'm not a Bush supporter by any means, but your goal is to recall Kwame - George Bush has nothing to do with that so don't go off on tangents. Just stick to saying why Kwame is a horrible mayor - there's plenty to work with without talking about Hitler, Stalin, the Holocaust, and Bush. | |

| Monday, July 28, 2008 Governor: Removal hearings for Mayor Kilpatrick could be Sept. 3 David Josar / The Detroit News
DETROIT -- Gov. Jennifer Granholm is accelerating her decision on whether to remove Detroit Mayor Kwame Kilpatrick from office, issuing a letter Monday saying "it is in the public interest" to do so.
"The governor has concluded that it is in the public interest to accelerate the briefing schedule in this matter and set a definite date for a hearing should one be determined necessary," wrote Kelly G. Keenan, the legal counsel to Granholm.
The letter was sent to Sharon McPhail, the mayor's general counsel; James C. Thomas, the mayor's privately retained attorney; and William Goodman, special counsel to the Detroit City Council.
Granholm has had requests from private citizens and the City Council to use her power to remove the mayor from office.
Council members also are seeking to remove Kilpatrick, believing they were duped into approving an $8.4 million whistle-blowers suit settlement that gave the mayor possession of potentially embarrassing text messages that may also indicated he committed perjury.
If Granholm determines a hearing is warranted, it would be held at 9 a.m. Sept. 3.
She wants both sides to submit briefs about the process by Friday, answers to those briefs by Aug. 15 and any briefs regarding any new issues by Aug. 22.
The short letter does not address why Granholm wants to accelerate the process, but it comes just days after Kilpatrick was accused of tussling with a detective who is investigating the criminal charges against him, and he had his bond radically modified.
The mayor has been charged with eight felony counts including perjury.
